These Terms of Service ("Terms") govern your access to and use of the FlexiShot website, online store, products, services, content, and related features (collectively, the "Services").
Throughout these Terms, "FlexiShot," "we," "us," and "our" refer to FlexiShot. "You" and "your" refer to the person accessing or using our Services.
Our store is hosted on Shopify, which provides the e-commerce platform that enables us to offer our products and Services to you.
Please read these Terms carefully before using our website or placing an order. By accessing, browsing, or using our Services, or by purchasing products from us, you agree to be bound by these Terms, together with any policies referenced or linked in these Terms.
If you do not agree with these Terms, please do not access or use our Services.
Nothing in these Terms is intended to exclude, restrict, or modify any rights or remedies you may have under applicable consumer protection laws, including the Australian Consumer Law where applicable.
1. Eligibility and Use of Our Services
By using our Services, you represent that you are legally capable of entering into a binding agreement under the laws applicable to you.
If you are under the age of majority in your place of residence, you may use our Services only with the involvement and consent of a parent or legal guardian where required by applicable law.
You agree to use our Services only for lawful purposes and in accordance with these Terms.
You must not use our Services:
- for any unlawful, fraudulent, or unauthorized purpose;
- to violate any applicable law or regulation;
- to infringe upon the intellectual property or other rights of FlexiShot or any third party;
- to interfere with or disrupt the operation or security of our website or Services;
- to transmit viruses, malware, or other harmful code;
- to attempt to gain unauthorized access to our systems, accounts, or data; or
- in any manner that could harm FlexiShot, our customers, our service providers, or other users.
We reserve the right to suspend or terminate access to our Services where reasonably necessary, including where we believe these Terms have been violated or the Services are being used unlawfully or abusively.
2. Our Products
We make reasonable efforts to ensure that product descriptions, specifications, images, colors, and other information displayed on our website are accurate and current.
However, product colors and appearance may vary depending on your device, screen, display settings, lighting, or other factors.
Product descriptions, specifications, availability, pricing, and other information may be updated from time to time.
We reserve the right to discontinue products, modify product offerings, or limit quantities available for purchase, subject to applicable law.
Nothing in this section limits any consumer guarantees or other mandatory rights that apply to products purchased from FlexiShot.
3. Orders and Order Acceptance
When you place an order through our website, you are submitting a request to purchase the products in your order.
After your order is submitted, you will generally receive an order confirmation email acknowledging that we have received your order. This acknowledgement does not necessarily mean that your order has been accepted for fulfillment.
An order is accepted when FlexiShot confirms that the order has been accepted and proceeds with fulfillment.
We reserve the right to decline, limit, or cancel an order where permitted by applicable law, including in circumstances such as:
- product availability issues;
- pricing or listing errors;
- suspected fraud or unauthorized transactions;
- unusually large or repetitive orders;
- suspected resale or commercial distribution;
- incorrect or incomplete order information; or
- circumstances where we are unable to fulfill the order.
If we cancel or materially change an order after payment has been received, we will notify you using the contact information provided with the order and provide any refund required by applicable law.
Your purchases are subject to our Return & Refund Policy, which forms part of these Terms.
4. Order Cancellation
Because FlexiShot fulfills orders through international fulfillment facilities, orders may enter processing shortly after payment is received.
You may request cancellation within 6 hours of placing your order, or before processing begins, whichever comes first.
We will make reasonable efforts to accommodate cancellation requests received within this period.
Once an order has entered the shipping process, it can no longer be canceled through our standard cancellation process.
If you receive an order that you wish to return after delivery, please refer to our Return & Refund Policy.
Nothing in this section limits any cancellation, refund, or other rights that may apply under applicable consumer protection laws.
5. Prices, Payments, and Billing
Product prices displayed on our website are subject to change without notice. The price applicable to your purchase is generally the price displayed at the time you place your order, subject to any obvious pricing error or applicable legal requirements.
We may offer discounts, promotional pricing, bundles, or other offers from time to time. Promotional offers may be subject to additional terms and conditions.
Unless otherwise stated at checkout, applicable taxes, duties, customs charges, or other government-imposed charges may apply depending on your location and the applicable laws.
Our standard shipping option is currently offered for a flat fee of $4.90 per order, as described in our Shipping Policy.
You agree to provide accurate and complete billing, payment, shipping, and contact information.
You represent that you are authorized to use the payment method provided for your purchase.
If payment cannot be successfully processed, we may be unable to fulfill the order until payment has been successfully received.
6. Shipping and Delivery
FlexiShot fulfills orders through trusted fulfillment facilities in China and ships internationally.
Orders are generally prepared and shipped within 1 to 3 business days after payment has been successfully received.
Estimated delivery times are:
United States
- Estimated delivery after shipment: 7 to 15 business days
- Estimated total time from order to delivery, including processing: approximately 8 to 18 business days
International destinations
- Estimated delivery after shipment: 9 to 18 business days
- Estimated total time from order to delivery, including processing: approximately 10 to 21 business days
These delivery estimates are provided for guidance only and are not guaranteed.
International shipments may involve customs clearance, international transportation, carrier handoffs, local delivery, weather disruptions, public holidays, peak periods, and other circumstances outside our reasonable control.
Once an order has shipped, we will provide tracking information where available.
Tracking information may take up to 48 hours to become active after shipment.

Nothing in these Terms or our Shipping Policy excludes or limits any rights you may have under applicable consumer protection laws.
7. Shipping Address
You are responsible for providing a complete and accurate shipping address at checkout.
You may request a shipping address change before your order has been prepared for shipment. Once an order has been prepared for shipment, the delivery address can no longer be changed.
If a package is returned because an incorrect or incomplete address was provided by the customer, an additional shipping fee may apply before the package can be resent.
If the issue resulted from an error on our part, we will cover the reasonable cost of reshipping.

8. Returns, Refunds, and Consumer Rights
Returns, refunds, replacements, and other remedies are handled in accordance with our Return & Refund Policy.
Our Return & Refund Policy forms part of these Terms.
Where applicable, consumers may also have mandatory rights and remedies under consumer protection laws, including the Australian Consumer Law.
Nothing in these Terms, our Return & Refund Policy, or any other policy on our website is intended to exclude, restrict, or modify any consumer guarantee, statutory right, or remedy that cannot lawfully be excluded, restricted, or modified.
If a product does not meet applicable consumer guarantees, we will provide the remedy required by applicable law.
9. Product Information and Availability
We make reasonable efforts to maintain accurate product information on our website.
However, occasional errors, inaccuracies, omissions, or outdated information may occur, including in relation to:

are owned by FlexiShot or our licensors, or are used with permission, and may be protected by applicable intellectual property laws.
You may access and use our website for your personal, non-commercial purposes.
Unless permitted by law or expressly authorized by FlexiShot in writing, you must not reproduce, copy, distribute, modify, publish, create derivative works from, sell, exploit, or otherwise use our content or intellectual property for commercial purposes.
Nothing in these Terms grants you any ownership interest or license in FlexiShot's intellectual property except for the limited right to use our Services in accordance with these Terms.

11. Customer Reviews, Feedback, and Submissions
If you submit reviews, comments, feedback, photographs, suggestions, ideas, testimonials, or other content to FlexiShot ("Feedback"), you remain responsible for the content you submit.
By submitting Feedback, you grant FlexiShot a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, display, distribute, adapt, and otherwise use that Feedback for purposes related to operating, improving, marketing, and promoting our Services, subject to applicable law.
You represent that:
- you own or have the necessary rights to submit the Feedback;
- your Feedback does not infringe the rights of another person;
- your Feedback is not unlawful, fraudulent, defamatory, abusive, obscene, or misleading; and
- your Feedback does not contain malware or other harmful code.
We may, but are not obligated to, review, moderate, edit, or remove Feedback where we reasonably believe it violates these Terms, applicable law, or the rights of others.
We do not guarantee that all Feedback will be published or retained.

FlexiShot is not responsible for third-party websites, services, content, products, or practices that we do not control.

13. Shopify
FlexiShot's online store is powered by Shopify, which provides the e-commerce platform through which we offer our products and Services.
However, purchases made through our website are transactions between you and FlexiShot.
Shopify is not the seller of FlexiShot products and is not responsible for the products, fulfillment, shipping, returns, refunds, or other aspects of transactions between you and FlexiShot.
Shopify's role in providing the platform does not change FlexiShot's responsibilities to you under applicable law.
14. Privacy
Your use of our Services and the personal information you provide to us are subject to our Privacy Policy, which forms part of these Terms.
Because our store is hosted on Shopify, certain information relating to your use of our Services may also be collected or processed by Shopify and other service providers involved in operating our store, processing payments, fulfilling orders, providing customer support, and delivering other Services.

15. Prohibited Uses
You may use our Services only for lawful purposes.
You must not use our Services to:
- violate any applicable law or regulation;
- infringe or violate intellectual property rights or other rights of FlexiShot or others;

- interfere with the security or operation of our website;
- upload or transmit malicious code, viruses, or harmful software;
- collect or misuse personal information belonging to others;
- spam, phish, or engage in fraudulent activity;

We do not guarantee that:
- our website will always be available or uninterrupted;
- our Services will always be secure or error-free;

- every feature of our website will always operate without interruption.
We do not make warranties or representations beyond those expressly required by applicable law or expressly provided by FlexiShot.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or other statutory right that cannot legally be excluded, restricted, or modified.
18. Limitation of Liability
To the fullest extent permitted by applicable law, FlexiShot and its directors, officers, employees, affiliates, contractors, service providers, agents, and licensors will not be liable for indirect, incidental, special, punitive, or consequential loss or damage arising from your use of our Services, except where such liability cannot lawfully be excluded or limited.
This may include loss of profits, revenue, data, business opportunities, or other indirect losses.
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, statutory right, or remedy that cannot legally be excluded, restricted, or modified.
19. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless FlexiShot and its directors, officers, employees, affiliates, contractors, service providers, agents, and licensors from reasonable losses, liabilities, claims, and expenses arising from:
- your material breach of these Terms;
- your unlawful use of our Services;
- your violation of another person's rights; or
- your fraudulent or intentionally wrongful conduct.
This section does not apply to the extent that the relevant claim, loss, or liability was caused by FlexiShot's own unlawful conduct, negligence, or breach of applicable law.
20. Termination
We may suspend or terminate your access to our Services where reasonably necessary, including if you materially breach these Terms, engage in unlawful activity, misuse our Services, or create a risk to FlexiShot, our customers, or our systems.
You may stop using our Services at any time.
Termination does not affect rights, obligations, or liabilities that arose before termination or provisions that by their nature are intended to continue after termination, including provisions relating to intellectual property, Feedback, privacy, liability, indemnification, and governing law.
21. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable where legally permitted.
If it cannot be made enforceable, it will be severed from these Terms without affecting the validity of the remaining provisions.
22. No Waiver; Entire Agreement
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.
These Terms, together with our Privacy Policy, Shipping Policy, Return & Refund Policy, and any other policies expressly incorporated into these Terms, constitute the agreement governing your use of our Services and purchases from FlexiShot, subject to any mandatory rights and obligations under applicable law.
If there is a conflict between these Terms and a specific policy relating to a particular transaction, the specific policy will apply to the extent necessary to address that matter, unless applicable law requires otherwise.
23. Assignment
You may not transfer or assign your rights or obligations under these Terms without our prior written consent, except where permitted by applicable law.
FlexiShot may transfer or assign its rights and obligations under these Terms as part of a business transfer, restructuring, merger, acquisition, or similar transaction, subject to applicable law.
24. Governing Law and Jurisdiction
These Terms are governed by the laws of New South Wales, Australia, to the extent permitted by applicable law.
You and FlexiShot submit to the courts of New South Wales, Australia, and courts entitled to hear appeals from them, subject to any mandatory jurisdiction or consumer protection rights that apply to you.
If you are located outside Australia, you may have mandatory consumer rights under the laws of your country or jurisdiction that cannot be excluded by these Terms.
Nothing in this section is intended to deprive you of any mandatory consumer protection rights available to you under applicable law.
25. Changes to These Terms
We may update these Terms from time to time to reflect changes to our Services, business practices, legal requirements, or other circumstances.
When we make changes, we will post the updated Terms on this page and update the "Last Updated" date above.
Where required by applicable law, we will provide additional notice of material changes.
Your continued use of our Services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
